This Privacy Policy applies to personal information we collect through the Site and in the course of providing our services, whether online or offline, including during live virtual and in-person sessions, classes, programs, and events.

By using the Site, you consent to the data practices described in this Privacy Policy. If you are subject to the GDPR, Company relies on specific legal bases for processing your personal information, which may include:

  • Performance of a contract (for example: delivering the programs, products, and sessions you purchase, processing payments, and scheduling sessions);

  • Your Consent (for example: subscribing to email newsletters, accepting optional cookies, completing a health screening to participate in breathwork, or submitting information via non-required contact forms);

  • Compliance with a legal obligation (for example: financial record-keeping or responding to lawful governmental requests);

  • Our legitimate interests (for example: operating and improving the Site, security, troubleshooting, conducting non-intrusive analytics, marketing, and communicating with customers about related services).

To provide you with services, Company may collect your “personally identifiable information,” such as your:

  • Mailing Address

  • Billing Address and payment information

  • Health and wellness information you provide through a health screening, intake form, or during a session

  • Your image, voice, and likeness, if you appear or are audible in a session we record

You are not required to enter your personal information to view Company's website.

Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through Company's social media, website comments, or on any of Company's public boards, groups, or pages, this information may be collected and used by others. Company is not responsible for unauthorized use of this information by third parties.

Sensitive Personal Information

Because we offer breathwork and other physical programs, we may ask you to complete a health screening and to acknowledge contraindications before you participate. That screening may include information about your health, which California law treats as sensitive personal information and which the GDPR treats as a special category of personal data. We may also collect account log-in credentials, which are also sensitive personal information.

We collect health information only with your consent, and we use and disclose it only as reasonably necessary to provide the services you request, to keep you safe during participation, to maintain security, and for the other limited purposes permitted by law. We do not use or disclose your health information to infer characteristics about you, and we do not sell or share your health information or other sensitive personal information for advertising.

How We Use Your Personally Identifiable Information

We do not collect any personal information about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain products or services available on the Site. These may include:

  • Entering your information on our Contact page;

  • Signing up for our free audio session or other free resources;

  • Purchasing or accessing our products, programs, or sessions;

  • Booking or scheduling a session;

  • Completing a health screening or intake form;

  • Signing up for our email list;

  • Creating an account or accessing our mobile application or members area;

  • Signing an agreement or waiver;

  • Emailing us;

  • Downloading our resources; and

  • Commenting anywhere on the Site.

Company may collect and use your personal information to, but not limited to, communicate with you, operate the Site, to perform its services, to provide services, to sell its products and services, to schedule and host sessions, to screen for safe participation in breathwork programs or other programs, to send you emails, and for marketing purposes. Company may also use your personally identifiable information to inform you of other products or services available from Company, as well as sharing resources with you. Company also may gather additional personal or non-personal information in the future.

Sharing Your Personal Information with Third Parties

Company does not sell, rent, or lease its customer lists to third parties.

Company may share data with trusted partners and suppliers (such as Squarespace, Squarespace Analytics, FG Funnels, Stripe, Google Workspace, Google Analytics, Flodesk, Acuity Scheduling, Zoom, Riverside, Buzzsprout, Hello Audio, Dropbox Sign, Apple, and others) when we work with such service providers on our behalf, such as to operate our website, host and deliver our podcasts, host and record our live sessions, process payments, schedule sessions, obtain electronic signatures, distribute our mobile application, send you emails, send you information, provide customer support, provide products and services, operate our company, operate our email list, perform statistical analysis, and market our services. All such third parties are prohibited from using your personal information except to provide these services to Company, and they are required to maintain the confidentiality of your information.

Advertising and cross-context behavioral advertising. Company uses the Meta (Facebook and Instagram) pixel and the Pinterest tag on the Site. Through these technologies, online identifiers and information about your activity on the Site are transferred to those advertising platforms so that we can market our services to you and measure our advertising. California law treats this as “sharing” for cross-context behavioral advertising, and it may be treated as a “sale.” We do not share your health information or other sensitive personal information for advertising. You may opt out as described below.

Affiliate links. Company shares affiliate links on the Site, in emails, in blog posts, on social media, and in podcasts. If you click an affiliate link, the third party may collect information about you under its own privacy policy. Company does not control those third parties.

Company may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) comply with the law or legal process served on Company or the Site; (b) protect and defend the rights or property of Company; and/or (c) act under exigent circumstances to protect the personal safety of users of Company or the public.

  • The Right to Delete: you have the right to request that we delete personal information we collected from you.

  • The Right to Opt Out of Sale or Sharing: you have the right to opt out of the sale or sharing of your personal information, including for cross-context behavioral advertising.

  • The Right to Limit Use of Sensitive Personal Information: you have the right to request that we limit the use of your sensitive personal information to what is necessary to provide the services you requested. As described above, we already limit our use of sensitive personal information to those purposes.

You may use an authorized agent to submit a request on your behalf if you provide the agent with written permission and we can verify your identity.

Opt-Out of Disclosure of Personal Information to Third Parties

If you are subject to the CCPA and certain other privacy and data protection laws, you have the right to opt-out of the disclosure of your personal information to third parties for business purposes. If you exercise your right to opt-out of the disclosure of your personal information, we will refrain from disclosing your personal information, unless you subsequently provide express authorization for the disclosure of your personal information. Many browsers offer a Do Not Track setting. Because there is no common industry standard for those signals, our Site does not currently respond to Do Not Track signals. Third parties, including our advertising partners, may collect personal information about your online activities over time and across different websites when you use our Site.

How Long We Keep Your Personal Information

We will keep your non-client personal information until you unsubscribe from our marketing or ask us to delete your personal information. Typically, data associated with marketing subscriptions is deleted within thirty (30) days of the unsubscribe request, and automated data like log files and basic analytics are retained for a maximum of fourteen (14) months. If you are or have been a client, we will keep your personal information, including your health screening and waiver records, for at least four (4) years after you've engaged with Company or the Site, unless a longer retention period is required by law.

How We Keep Your Personal Information Secure

Your privacy is important to Company, and Company has security measures in place to prevent your personal information from unauthorized use, access, disclosure, and modification. Additionally, Company has taken steps to deal with any suspected data breaches and will notify authorities and you of any such breaches if legally obligated to do so.

Tracking User Behavior

Company may keep track of the websites and pages our users visit within Company, to determine which Company services are the most popular. This data is used to deliver customized content and advertising within Company to customers whose behavior indicates that they are interested in particular services or products.

Automatically Collected Information

Information about your computer hardware and software may be automatically collected by Company. This information can include, but is not limited to, the following: your IP address, browser type, domain names, access times, location, and referring website addresses. This information is used for the operation of the Site, to maintain quality of the service, marketing, and to provide general statistics regarding use of the Site.
